While the facts of the case focused upon whether contingent (“adjunct”) faculty members at private colleges and universities can unionize, the NLRB decision may have an significant impact upon the landscape of U.S. Catholic higher education.
Why? Moving forward, the NRLB fully expects an institution to fulfill its religious mission—to make it promient in the classroom—through its faculty in the classrooms, while advising, and in conducting reserach, if that institution is to be excluded from the provisions of the National Labor Relations Act.
